AN ACT ENTITLED THE "MISSISSIPPI HEALTH INSURANCE EXCHANGE ACT OF 2009"; TO PROVIDE DEFINITIONS; TO ESTABLISH THE MISSISSIPPI HEALTH INSURANCE EXCHANGE AS AN INSTRUMENTALITY OF THE STATE OF MISSISSIPPI; TO PROVIDE FOR THE APPOINTMENT OF A BOARD OF DIRECTORS OF THE EXCHANGE AND EMPOWER THE BOARD TO APPOINT AN EXECUTIVE DIRECTOR AND ORGANIZE FOR BUSINESS; TO PRESCRIBE THE POWERS AND RESPONSIBILITIES OF THE EXCHANGE; TO PROVIDE FOR ENROLLMENT AND COVERAGE ELECTION UNDER THE PROGRAM; TO PROVIDE REQUIREMENTS FOR PARTICIPATION OF PLANS IN THE EXCHANGE; TO PRESCRIBE UNDERWRITING RULES FOR THE EXCHANGE; TO PROVIDE FOR CONTINUATION OF COVERAGE; TO PROVIDE FOR DISPUTE RESOLUTION; TO PROVIDE FOR PARTICIPATING EMPLOYER PLANS; TO PROVIDE FOR THE PAYMENT OF COMMISSIONS TO INSURANCE PRODUCERS; TO BRING FORWARD SECTIONS 83-63-1, 83-63-3, 83-63-5, 83-63-6, 83-63-7, 83-63-9 AND 83-63-11, MISSISSIPPI CODE OF 1972, WHICH SET FORTH PROCEDURES FOR PREMIUM RATES AND RESTRICTIONS ON PREMIUM RATE INCREASES FOR HEALTH BENEFIT PLANS PROVIDING COVERAGE TO EMPLOYEES OF SMALL EMPLOYERS, LIMITATIONS ON THE ESTABLISHMENT OF CLASSES OF BUSINESS BY A SMALL EMPLOYER CARRIER, DISCLOSURE REQUIREMENTS FOR SMALL EMPLOYER CARRIERS AND PROCEDURES FOR RENEWING COVERAGE, FOR THE PURPOSES OF AMENDMENT; AND FOR RELATED PURPOSES.
